TERMS AND CONDITIONS

1. Applicability general terms and conditions

The website www.momentsbycontent.be is owned by Atelier Content BV. The firm Atelier Content BV is registered in the Central Database for Enterprises under the number BE(0)567.961.922. Each order is seen as an explicit acceptance of the terms and conditions by the Purchaser. These terms and conditions are an integral part of the agreement outlined below.

2. Prices and offers

The prices listed for the products and services offered are in euros, including VAT and excluding shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing. We accept payments via Bancontact, iDEAL, Visa, Mastercard, American Express and wire transfers. These are also indicated during the ordering process. The date of crediting the bank account of Atelier Content counts as the date of payment. If you are in default with any payment, Atelier Content is entitled to suspend or dissolve (the execution of) the relevant agreement and any related agreements. All offers by Atelier Content are without obligation and Atelier Content expressly reserves the right to change the prices. Should the prices of the products and services offered increase in the period between the order and its execution, you are entitled to cancel the order and dissolve the agreement within seven (7) days after being notified of the price increase by Atelier Content.

3. Accepting the order

Atelier Content is only bound by an order after it has been confirmed by Atelier Content by e-mail or after its execution has started. Atelier Content is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. All product information, pricing and order information at all times remain subject to possible changes and corrections.

4. Delivery

The delivery times mentioned by Atelier Content are merely indicative. Should any delivery period per exceeded, this does not entitle you to compensation, nor does it entitle you to cancel your order or to dissolve the agreement, unless thedelivery period has been exceeded to such an extent that you can no longer reasonably be expected to maintain the agreement. In such a case, you are entitled to cancel the order or the agreement insofar this is necessary. The responsibility for incorrect delivery addresses lies entirely with the Purchaser and may result in additional costs. In the event of non-delivery of the goods, any sums paid by the Purchaser shall be refunded without interest or other compensation.

5. Complaints

Complaints need to be directed in written to Atelier Content via info@momentsbycontent.be to be admissible:  In the event of a complaint about non-conformity of delivery, within seven (7) days of ordering. - In case of hidden defects, seven (7) days after discovery of the defect. In this written communication, you need to describe the damage and demonstrate it via a photo.

6. Warranty

The warranty provided by Atelier Content is limited to a warranty for hidden defects and the warranty with regard to consumer purchases, both provided for in the Civil Code. Atelier Content is only responsible for damage that is the result of a gross error or evil intent. Atelier Content is not liable for general or special indirect damage of any kind, possibly suffered by the Purchaser.

7. Right of renunciation

The consumer reserves the right to inform the company that they are renouncing the purchase, without paying any penalty and without giving any reason, within 14 calendar days from the day following the delivery of the goods or the conclusion of the service agreement. In case the consumer makes use of this option, the goods need to be returned in the original state and packaging at his own risk and expense to Atelier Content BV, Zenobe Grammestraat 57, 9600 Ronse. We recommend using the Secur delivery service, so your package is insured in case of loss. Every return shipment must first be reported to info@momentsbycontent.be. Return shipments that were not reported will not be accepted. The costs of the return shipment are at the expense of the buyer.

8. Force Majeure

Atelier Content cannot be held liable for any possible delays in the execution or for non-execution of our commitments due to circumstances beyond Atelier Content’s control. Included are: difficulties in supply or shortages of raw materials, interruption or the permanent suspension of production, strikes, lock-outs, any other form of work stoppages or collective labour disputes, energy or transportation delays, which affect Atelier Content and/or suppliers of Atelier Content, even if these events are foreseeable. Failure to take immediate action against a shortcoming of the Purchaser can under no circumstances be considered as a renunciation of Atelier Content to invoke this shortcoming at a later date.

9. Personal data

Placing an order on the Moments by Content/Atelier Content site means the Purchaser officially consents to the processing of his personal data for administrative purposes such as: managing the customer base, orders, invoices and deliveries and the monitoring of the financial solvency. The processing of personal data for promotions, personalised advertising and/or any marketing related purposes will only happen if the Purchaser has given his explicit consent to this during the completion of the order process. This can be changed by the purchaser at any given time. Atelier Content will not share personal data with third parties. The Purchaser shall at all times retain the right to inspect and correct his personal data. The Buyer also reserves the right to object, free of charge, to the processing of his personal data for Direct Marketing initiatives. 10. Evidence

Within the framework of their relations, the Parties concerned shall accept electronic evidence.

11. Miscellaneous

Should an article in these terms and conditions be declared null and void, this invalidation shall in no way apply to the remaining articles. Atelier Content reserves the right to change the contents of these terms and conditions. Any modifications will be announced via the website.

12. Applicable laws

All agreements entered into Atelier Content are governed by Belgian law. All disputes between the parties shall exclusively be submitted to the competent court in Belgium.
